Terms and Conditions

Welcome to RefWhistle. These Terms and Conditions ("Terms") govern your access to and use of our sports administration, referee roster companion, and performance analytics platform. By logging into, installing, or interacting with the Service, you agree to be bound by these Terms.
These Terms are governed by the laws of the Australian Capital Territory (ACT), Australia, and comply with the Australian Consumer Law (ACL).
1. Account Eligibility and Security
- Authorized Access: You must be an authorized official, technical coach, appointer, or administrator explicitly registered by an affiliated sports association to hold an account.
- Credential Responsibility: You are entirely responsible for maintaining the confidentiality of your login credentials. Any activity performed under your account identity is your legal responsibility.
- Notification of Breach: You must immediately report any unauthorized use of your credentials or security vulnerabilities detected within the platform.
2. User Obligations and Acceptable Use
When uploading, reviewing, or interacting with data on RefWhistle, you agree that you will not:
- Submit inaccurate, false, malicious, or intentionally misleading information, including fabricated Key Match Incidents (KMIs) or performance grades.
- Use abusive, defamatory, discriminatory, or harassing language in technical coach reviews, change requests, or performance reports.
- Expose, download, or share confidential official profiles, compliance logs, contact listings, or evaluation metrics with external entities or public social media channels.
- Attempt to bypass, reverse engineer, or exploit vulnerabilities in our underlying software code, real-time notification pathways, or database systems.
3. Role-Based Permissions and System Rights
- Administrators & Appointers: Hold the right to draft, adjust, or cancel match allocations according to strict regional constraints, panel rankings, and technical safety metrics.
- Technical Coaches: Hold the authority to approve, deny, or append binding analytical notes to drafted assignments within their specific assigned competition categories.
- Match Officials: Retain the responsibility to update their availability cleanly and report match data, post-match summaries, and metrics within designated association timelines.
4. Intellectual Property
- Platform Content: All code, interfaces, design frameworks, branding assets, custom layouts (including the bento box operational dashboards), and proprietary logic are the sole property of RefWhistle.
- User Data & Reports: By logging data, match cards, and performance assessments into the platform, you grant us an irrevocable, royalty-free, perpetual license to store, host, distribute, and analyze the data for the purpose of operating the Service and delivering organizational reports to your governing sports body.
5. Limitation of Liability and Disclaimers
- Platform Availability: While we aim for maximum uptime across our progressive web app framework and real-time database endpoints, the Service is provided on an "as-is" and "as-available" basis. We do not guarantee uninterrupted operational availability during critical match windows.
- Liability Cap: To the maximum extent permitted by the Australian Consumer Law, our liability for any failure to meet consumer guarantees is limited to the resupply of the services or the cost of resupplying the services. We are not liable for any indirect, incidental, or consequential losses stemming from cancelled fixtures, unassigned slots, or match log errors.
6. Termination of Service
We reserve the right to suspend, restrict, or completely terminate your access to the platform without prior notice if we find you in material breach of these Terms, if your contract with the governing sports association expires, or if your behaviors undermine the regulatory integrity of the officiating community.
7. Modifications to the Terms
We reserve the right to update these Terms at any time to account for fresh feature releases, progressive web architecture adjustments, or legislative updates under Australian law. Your continued utilization of the platform post-revision constitutes acceptance of the modified Terms.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of the Australian Capital Territory, Australia. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the ACT.
